Terms and Conditions of Sale

  1. Registration: All bidders must register before the auction. This includes reviewing and signing a Bidder/Buyer registration form whereby all bidders agree to these Terms and Conditions of Sale. Bidders are solely responsible for the use of their bidder number. Any use of the number by another person is presumed to be with the permission of the registered bidder and is contractually binding on that bidder. Bidders must be at least 18 years of age and consent (children under the age of 16 are prohibited from auctions and previews) and are subject to background checks upon registration. Photo ID is required for admission and registration.
  2. Inspection / Recording / Bids: Bidders are invited to inspect goods prior to auction. Failure to inspect goods shall not constitute cause for cancellation of sale. Bulward reserves the right to refuse or restrict bidders suspected of conspiring to influence the bidding process. Bulward reserves the right to reject any bid. Minimum reserve prices may be set on any lot or good. Bulward may withdraw lots or goods if minimum reserve prices are not achieved. Bulward reserves the right to withdraw items listed in the auction catalog. If Bulward needs to retrieve an item already purchased, bidder agrees to release such item to Bulward. In this case, Bulward will refund the item price plus 10% to the bidder. Bulward reserves the right to video tape auction proceedings.
  3. Oral Statements and Modifications: Clarifications regarding lots and goods may be made the day of the auction and will take precedent over previously conveyed information. Clarifications shall not alter the Terms and Conditions of Sale or Warranty Disclaimer and Release. No interpretation of a clarification shall be binding on Bulward unless agreed to in writing by an authorized agent of Bulward.
  4. Submission of Bids and Award: Auctioneer will offer each numbered item separately. Bidders will communicate bids in any manner acceptable to the Auctioneer. Highest bids in excess of minimum reserve prices will be awarded the item. In the event of a dispute as to bid amount, item or item number, or paddle number of bidder, Bulward reserves the right to re-offer the item in question. Once Bulward accepts a bid, the bid cannot be withdrawn. All bidder disagreements will be resolved by Bulward in accordance with the invoice terms (i.e., name and number of bidder and bid items) and other applicable evidence. By placing a bid, the bidder acknowledges full understanding of these Terms and Conditions of Sale, including Bulward’s Warranty Disclaimer and Release and agrees to be bound thereby.
  5. Payment: All payments must be made in cash or by credit card or as directed by Auctioneer. Other forms of payment must be authorized by Bulward in advance. Payment of the full purchase price must be made at the conclusion of auction proceedings and prior to delivery of the goods. Cash payments of $10,000 or more will be reported to the IRS. Upon full payment of purchase price, Bulward will issue a receipt to the registered bidder only. Bulward reserves the right to refuse or restrict bidders at future auctions who fail to make payment on winning bids.
  6. Limitation of Liability: All sales are final. Bulward’s liability shall be limited to, at Bulward’s sole option, a refund of such portion of the purchase price paid by bidder or replacement of any good purchased with a similar product. All refunds must be authorized by Bulward, in writing.
  7. Delivery, Loading, and Removal: Bidder will make all arrangements for removal of all items purchased, at bidder’s expense. Bulward employees are not authorized to assist in the loading of any goods. Goods will be released to the winning bidder at a designated pickup area upon presentation of a sales receipt. Any discrepancy issues must be raised at the time the goods are released to the winning bidder. Segregation or abandonment of goods may result in denial of access to future auctions. Failure to remove goods within the allowed time frame will result in forfeiture of the goods. Bulward shall be entitled to retain any money paid by bidder as a restocking fee and/or liquidated damages. Bulward makes no warranties as to the suitability of items for shipment.
  8. Compliance with Law and Indemnity: Utah law shall govern this Agreement. Bidder is responsible to comply with applicable federal, state and local laws pertaining to the purchase, transportation, and use of purchased items. Bidder shall indemnify and hold harmless Bulward from and against any claim loss or damage, of any kind, arising from or as a result of bidder’s purchase, use or resale of any good and its conduct. Bidder is responsible for all taxes. Sales tax will be collected at time of payment, unless a valid tax exemption certificate is tendered at registration.
  9. Warranty Disclaimer and Release: BULWARD (AS OWNER AND/OR CONSIGNEE) DOES NOT WARRANT THE AUTHENTICITY, CONDITION, QUALITY OR VALUE OF AUCTIONED GOODS, INCLUDING CONFORMITY THEREOF TO ANY APPLICABLE STATE OR FEDERAL LAW (I.E., COPYRIGHT, TRADEMARK, LICENSING, ETC.). SELLER EXPRESSLY DISCLAIMS ALL IMPLIED AND EXPRESS WARRANTIES OF ANY KIND RESPECTING THE AUCTIONED GOODS, INCLUDING THE IMPLIED WARRANTIES OF “MERCHANTABILITY” AND “FITNESS FOR PARTICULAR USE OR PURPOSE.” SELLER DOES NOT WARRANT THE CONDITION OF AUCTIONED GOODS. GOODS ARE SOLD “AS IS,” “WHERE IS,” AND CONSTITUTE SALVAGED, USED, DISTRESSED AND/OR LIQUIDATED PROPERTY. BUYER ACKNOWLEDGES ITS CONSENT HERETO AND RELEASES SELLER FROM ANY AND ALL LIABILITY ASSOCIATED WITH THE GOODS AND BUYER’S PURCHASE THEREOF, INCLUDING ANY INCIDENTAL AND CONSEQUENTIAL DAMAGES. BUYER ACCEPTS ALL LIABILITY AND RESPONSIBILITY RESPECTING PURCHASED GOODS, INCLUDING RESPONSIBILITY FOR THE PROPER TRANSPORTATION, MAINTENANCE, USE, RESALE AND/OR CARE THEREOF.

Bulward may modify these Terms and Conditions of Sale as deemed necessary.
